3. Use of Third-Party Service Providers
TLG acts as an intermediary and may engage, refer, or coordinate third-party platforms and providers to deliver services (including, for example, calendar booking, document preparation, e-signature, payment processing, secure messaging, and cloud-hosted backend services). These third parties are independent of TLG, operate under their own terms of service and privacy policies, and are solely responsible for the services they provide. TLG does not control and is not responsible for the acts, omissions, errors, fees, pricing, or work product of any third-party provider.
4. Data Privacy & Security
We take the confidentiality of your personal information seriously. Information you submit through this website is transmitted over encrypted connections (TLS) and stored using reputable third-party cloud infrastructure that employs encryption at rest, access controls, and role-based row-level security. We do not sell your personal information. We share your information only with the third-party professionals and service providers reasonably necessary to deliver the services you have requested, or as required by law. You may request access, correction, or deletion of your personal information at any time by contacting consult@tolbertlegacygroup.com. California residents have additional rights under the California Consumer Privacy Act (CCPA/CPRA), which may be exercised by contacting us at the same address.
5. No Legal, Tax, or Financial Advice
The content on this website and any communications from TLG are provided for general informational and educational purposes only. They do not constitute legal, tax, accounting, financial, investment, or insurance advice, and should not be relied upon as such. Estate planning, trust formation, tax strategy, real estate transactions, and insurance decisions are highly fact-specific and depend on your individual circumstances and applicable law, which varies by jurisdiction and changes over time.
You are strongly advised to consult with a licensed attorney, certified public accountant (CPA), and/or other appropriately licensed professional to independently verify any information provided and to obtain advice specific to your situation before making any decision or taking any action.
6. No Guarantees
TLG makes no representations, warranties, or guarantees, express or implied, regarding any specific outcome, result, benefit, tax savings, investment return, asset protection, qualification for any program, approval, valuation, or timeline. Past results are not indicative of future performance. All information is provided "as is" and "as available" without warranty of any kind, including warranties of merchantability, fitness for a particular purpose, accuracy, completeness, or non-infringement.
7. No Attorney–Client or Fiduciary Relationship
Use of this website, submission of a form, scheduling a consultation, or other communication with TLG does not create an attorney–client, accountant–client, broker–client, agent–client, or fiduciary relationship between you and TLG. Any such relationship with a licensed professional must be established by a separate, signed engagement or representation agreement.
8. Equal Housing & Fair Practices
TLG and its affiliated providers support the principles of the Federal Fair Housing Act and the Equal Credit Opportunity Act. We do not discriminate on the basis of race, color, religion, sex, sexual orientation, gender identity, familial status, national origin, disability, age, marital status, source of income, or any other characteristic protected by applicable federal, state, or local law.
9. Insurance Disclosure
Life insurance, final expense, burial insurance, annuity, and related insurance products are offered through licensed insurance carriers and are subject to underwriting approval, policy terms, exclusions, limitations, riders, premiums, waiting periods, and conditions of the issuing carrier. Product availability, features, benefits, premiums, and issue ages vary by state, by carrier, and by applicant health, age, and lifestyle. Insurance products are not bank deposits, are not FDIC insured, are not guaranteed by any government agency, and may lose value where applicable.
Licensed Producer. Nichole Howard-Tolbert is a licensed life insurance producer (California Life License No. 4520909) acting as an independent agent/broker. We are not affiliated with, endorsed by, or sponsored by any federal or state government agency, Medicare, the Social Security Administration, or the U.S. Department of Veterans Affairs. We do not represent every insurer or every product available in your state, and the policies we recommend may not be the lowest-cost option available to you.
No Guarantee of Coverage. Submitting an application or a request for a quote does not create a contract of insurance and does not guarantee that coverage will be issued, that any specific premium will be offered, or that any death benefit will be paid. Coverage is not in force until an application has been accepted by the insurance carrier, the policy has been issued and delivered, and the initial premium has been paid in accordance with the policy's terms. Any benefit, cash value, dividend, or interest rate illustration is hypothetical, is provided by the issuing carrier, and is not a promise or guarantee of future results.
Suitability & Replacement. You are responsible for reviewing your existing coverage before making any change. Replacing or surrendering an existing policy may result in surrender charges, loss of accumulated benefits, new contestability and suicide-exclusion periods, higher premiums based on current age or health, and loss of riders that may not be available on a new policy. You should consult with a qualified professional before replacing any in-force policy.
Application Accuracy. All statements made in an insurance application — including statements regarding age, health, tobacco use, prescriptions, income, occupation, and avocations — must be complete and truthful. Material misrepresentations or omissions may result in rescission of the policy, denial of a claim, or reduction of benefits by the carrier, and neither TLG nor the producer is responsible for any such denial or rescission.
Compensation Disclosure. When a policy is issued, the producer and/or TLG may receive commissions, overrides, bonuses, or other compensation from the issuing carrier. This compensation does not increase the premium you pay. Additional compensation disclosures are available upon request.
10. Forward-Looking Statements & Testimonials
Any forward-looking statements regarding strategies, savings, or outcomes are based on assumptions that may not occur. Testimonials, endorsements, or case examples reflect the individual experiences of specific clients and are not a guarantee that you or any other person will achieve the same or similar results.
11. Limitation of Liability
To the maximum extent permitted by applicable law, TLG, its owners, members, officers, employees, contractors, and affiliates shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenue, data, goodwill, or other intangible losses, arising out of or in connection with your use of this website, our services, or any third-party provider engaged through us, whether based in contract, tort, statute, or otherwise.
